SettleTerms™ Terms of Service
Effective date: 5 October 2026
The short version
SettleTerms is software. It helps two people who are separating or divorcing in New York see what has to be decided, say what each of them wants, find out where they already agree, and work on the rest with a built-in mediator called Neutra™, which is also software. At the end you have a written report of what you agreed.
SettleTerms is not a law firm and does not give legal advice. Nobody at SettleTerms is your lawyer, and Neutra™ is not a person. Nothing you agree here is binding until you sign a proper written agreement, and you have the right to have your own attorney read anything before you sign it.
The rest of this document says the same things in more detail. Please read it. By creating an account or using SettleTerms you agree to it.
1. Who we are
SettleTerms is operated by SettleTerms LLC, a Florida limited liability company, Florida document number L26000498862 ("SettleTerms", "we", "us"). Our mailing address is 17105 Journeys End Dr, Odessa, FL 33556. You can reach us at hello@settleterms.com.
SettleTerms is owned by Val Kleyman, an attorney admitted to practice in New York. That does not make him, or any law firm he is part of, your lawyer. See section 4.
2. What SettleTerms is for
SettleTerms is for two adults who are ending a marriage, or who are parents who were never married and are separating, and whose case would be decided in the courts of the State of New York. The figures it calculates are New York figures. It is not built for any other state, and it is not for you if your case belongs somewhere else.
You must be at least 18 to use it.
3. What SettleTerms does, and what it does not do
It does:
- Ask each of you questions, separately, and show each of you the list of issues a New York court would need decided in your situation.
- Calculate what New York's formulas produce for child support and spousal maintenance on the figures you enter, and explain how the formulas work.
- Let each of you record what you want on each issue, privately, and then show both of you where you already agree and where you do not.
- Provide Neutra™, a software mediator, to help the two of you work on the issues where you differ, one at a time, each of you in a private conversation.
- Produce a report of everything you agreed and everything still open, with the arithmetic behind it, that you can print, keep and take to a professional.
It does not:
- Give legal advice, tell either of you what to accept, or recommend a settlement.
- Predict what a judge would do.
- Propose anything about your children or your pets. It records what the two of you decide about them, and nothing more.
- Prepare, draft or file any court document or settlement agreement.
- Represent either of you, or act for either of you with anyone.
The calculations are arithmetic applied to what you enter, under New York's statutes as of the date shown on the results. If what you enter is wrong, the figures are wrong. Statutory caps and percentages change from time to time. The figures are estimates for the two of you to work from, not a determination of what a court would order.
4. No lawyer, no legal advice, no attorney-client relationship
Using SettleTerms does not create an attorney-client relationship between you and SettleTerms, its owner, or anyone who works on it. Nothing on the site, in the report, or said by Neutra™ is legal advice. If you need legal advice, speak to a lawyer of your own.
Val Kleyman's law practice does not take cases that come through SettleTerms and will not represent either party to a SettleTerms case. If you contact that practice about your case, it will decline.
Neutra™ is not a person, not a lawyer, and not a mediator certified by any court or body. It is software. Its conversations with you are not privileged and are not confidential in the way a conversation with your own lawyer is. See section 9.
You represent yourself. SettleTerms does not appear for you anywhere and does not speak for you to the other person, to a court, or to anyone else.
Have your own attorney read anything before you sign it. Each of you can have your own. What you agree using SettleTerms does not bind either of you until it is put in a written agreement that both of you sign in the form New York law requires.
If you ask us for a lawyer, we may give you the names of independent attorneys or tell you where to find one. SettleTerms is not a lawyer referral service, does not endorse or recommend any attorney, has no arrangement with any attorney, and receives nothing from any attorney you hire. Whoever you hire is your choice, and your agreement with them is yours alone.
5. Two people, two accounts
Each of you uses your own account, with your own email address, and answers for yourself. You may not answer for the other person, sign in as them, or open their account. If one of you invites the other, the other is free to decline, and declining is a real answer.
Keep your sign-in link to yourself. Sign out when you use a shared computer. A sign-in link or invitation link sent to you is yours alone; forwarding it lets whoever receives it act as you.
You are responsible for keeping what you enter accurate. Both of you are relying on it.
6. What the other person sees, and what they never see
SettleTerms is built so that neither of you can see the other's private work. Specifically:
- The other person never sees your answers to the assessment. Once both of you have answered, each of you sees a comparison built from both sets of answers, in your own words, and the figures the formulas produce.
- Once both of you have entered a position on an issue, both of you see both positions. Until both are in, neither sees the other's.
- Your private conversation with Neutra™ is never shown to the other person.
- In a mediation round, what you enter is sealed until the other person has entered theirs, then both are shown to both of you. Your private "last word", if you give one, is never shown to anyone, however the round ends.
- The other person is never told how you answered the safety questions.
- If you decline an invitation, the person who invited you is told only that you are not going ahead, not why.
7. Safety
Before anything else, each of you is asked a short set of safety questions, separately. If your answers indicate that you may not be safe, or that you could not hold your own in a disagreement with the other person, SettleTerms will stop and point you to people who can help. That is deliberate. Your answers to those questions are never stored and are never shown to anyone.
SettleTerms is not an emergency service. If you are in danger, call 911. The New York State Domestic and Sexual Violence Hotline is 1-800-942-6906, free, confidential, at any hour.
8. The fee and the refund
The fee. SettleTerms costs $499 for the two of you together, charged once, to the person who sends the invitation, at the moment it is sent. The first part, the assessment, is free, and you can stop there. The price is shown before you pay. There are no other charges from us.
During the launch period, the fee is waived. Nothing is charged and no card is asked for. The price above is what it will cost after the launch period, and the site will say so before that changes. While the fee is waived, the refund below has nothing to refund.
The refund. The fee is for the two of you to work through your case together. If the other person does not finish their own assessment within 30 days of the invitation, whether because they declined, never opened it, or started and stopped, we refund the full fee, including the card processing cost. You do not need to ask; if it has not been refunded within 7 days after the 30 days, write to us.
Once the other person has finished their assessment, the fee is earned and is not refunded, whether or not the two of you go on to settle anything. What you get for it is the comparison, Neutra™ and the report, and you keep those whatever happens.
Payment. Payments are taken by Stripe. Your card details go to Stripe and never to us; we keep a record of the payment, not the card.
9. Confidentiality, and the limits of it
We take your privacy seriously and our Privacy Policy explains what we store and what we never store. But you need to know two things plainly:
- What you enter may not be privileged. New York protects some communications made in mediation, but that protection generally depends on the mediation being conducted by a qualified mediator, and Neutra™ is software. We do not promise that anything you enter, say to Neutra™, or receive from SettleTerms is privileged or protected from disclosure.
- It may be requested in court. If either of you later goes to court, the other side, or the court, may seek the report, your positions, or other records from you or from us. We will comply with valid legal process, and we will tell you if the law allows us to.
Enter what you need to enter, and no more. The product is built to ask for structured answers rather than long written explanations for this reason.
10. Your report is yours
The report SettleTerms produces is yours to keep, print, and give to anyone you choose. Both of you get it. It records what the two of you agreed and what remains open, with the figures and how they were reached. It is a record of an agreement in principle, not a settlement agreement, and it does not become one until it is written up and signed in the form New York law requires. Whether a court accepts the agreement the two of you eventually sign is the court's decision, and SettleTerms does not promise that it will.
11. Things you may not do
You may not use SettleTerms to pressure, deceive or harass the other person, or anyone else. You may not enter information about a person who has not agreed to take part, beyond the name and email address needed to invite them. You may not use SettleTerms for a case that is not yours, sign in as anyone but yourself, try to reach any part of the system you are not meant to reach, copy the site, or interfere with it. You may not use SettleTerms if you are under 18.
If you break these rules we may close your account. If we close it for a breach of this section, the refund in section 8 does not apply.
12. Ending your use of SettleTerms
You can stop at any time. You can export what you entered and you can delete your case from within the product. Deleting a case removes it for both of you, and the other person will find it gone; the product tells you that before you confirm. Records we are required to keep, such as records of payments, are kept as the law requires.
We may suspend or end the service, or your access to it, if you break these terms, if the law requires it, or if we stop offering the service. If we stop offering it while your case is in progress and you have paid, we will refund the fee.
13. Our content, and yours
SettleTerms, its name, Neutra™, the site, the questions, the explanations and the software are ours or licensed to us. We give you a personal, non-transferable licence to use them for your own case. What you enter is yours; you give us the right to store it, process it and show it to you and, where these terms say so, to the other party, for the purpose of providing the service and for nothing else.
14. No warranties
SettleTerms is provided as it is. We do not promise that it is free of errors, that it will always be available, that its figures match what a court would order, or that the two of you will settle anything. Where the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. Nothing in this section limits rights you have as a consumer that cannot be limited.
15. Limits on what we are responsible for
To the extent the law allows, SettleTerms and its owner are not liable to you for any loss that is indirect, consequential, or that arises from the terms the two of you agree, from decisions either of you make, from the other person's conduct, or from information either of you entered. Our total liability to you for anything arising from SettleTerms is limited to the fee you paid us for the case concerned. Nothing in this section limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
16. Disputes
These terms are governed by the law of the State of Florida, without regard to its conflict-of-law rules. Any dispute about SettleTerms or these terms will be brought in the state or federal courts sitting in Hillsborough County, Florida, and you agree to their jurisdiction. Before filing anything, write to us at hello@settleterms.com and give us 30 days to sort it out.
17. Emails and notices
We will email you about your account and your case: your sign-in link, the invitation if you send one, a copy of your report if you ask for one, and notices about these terms. Those emails are part of the service. We will not send you marketing unless you ask for it. Notices to us go to hello@settleterms.com.
18. Changes
We may change these terms. If we do, we will post the new version with a new effective date and, for changes that matter, email you. If you keep using SettleTerms after the change, the new terms apply. A change never takes away a refund you were already entitled to.
19. The rest
These terms and the Privacy Policy are the whole agreement between you and us about SettleTerms. If a court finds any part of them unenforceable, the rest still applies. If we do not enforce something once, we can still enforce it later. You may not transfer your account or your rights under these terms; we may transfer ours to a successor that takes over the service, and will tell you if we do.
